A WISHAW man who defecated on a policeman during a struggle inside Motherwell Police Office has been jailed for four months.
James O’Neill (21), of Pentland Road, had a six-month prison term reduced to four on the basis of his guilty plea to doing the toilet on a male constable.
The sordid incident took place during a scuffle within the Windmillhill Street police headquarters in July, shortly after O’Neill had been taken to the station after being initially arrested in Wishaw.
Appearing for sentencing at Hamilton Sheriff Court yesterday, O’Neill’s solicitor told Sheriff Brown that the 21-year-old had started off on “a philosophical basis” and claimed he couldn’t remember the incident.
The charge read that O’Neill assaulted the constable, kicking him on the body, before struggling with him in the police station.
As the scuffle continued, the 21-year-old wrapped his legs around the constable’s waist, limiting the officer’s movement and then defecated on him.
O’Neill was in the Motherwell office after being arrested by police officers on Wishaw’s King Street on July 3.
He had initially been accused of culpably and recklessly throwing a glass bottle at a window of Wishaw police office in Stewarton Street.
He was then accused of behaving in a threatening or abusive manner, plus shouting, swearing and uttering threats of violence in King Street.
When officers tried to detain O’Neill, the 21-year-old threw his body weight violently from side-to-side, resisting officers by pulling his arms away sharply in an attempt to break their grip.
He was then charged on two separate counts of trying to assault constables whilst they were carrying out their duties by kicking them on the leg, then spitting on one of them.
When police officers reached Motherwell office with O’Neill, he was charged again for trying to kick a police officer on the leg.
It was then that O’Neill began to struggle with the constable, wrapped his legs around him and the sordid incident of defecation occurred.
O’Neill pleaded not guilty to throwing the glass bottle at the Wishaw Police Office window and kicking the police officers on the leg. His pleas were accepted by the court.
He admitted the charges of behaving in a threatening or abusive manner, resisting police and attempting to break their grip, spitting on a police officer and defecating on the constable in Motherwell Police Office.
Dressed in a chequered hooded top, O’Neill looked longingly into the Hamilton gallery as he was led to custody following his sentencing yesterday (Tuesday).
